Who is entitled to custody?

Custody primarily protects the child's interests. A mother generally has priority while she satisfies the legal requirements of capacity, trustworthiness and ability to care for the child, after which priority follows the prescribed order.

Types of maintenance

Maintenance may include food, clothing, accommodation, healthcare and education, assessed according to the provider's means and the child's needs. A father remains responsible for child maintenance even where the mother has independent means.

Interim maintenance may be requested while proceedings continue so that the child is not prejudiced by delay.

Contact and overnight stays

The non-custodial parent may seek contact, outings and overnight stays subject to the child's best interests. Orders can be enforced through the Sharia enforcement department.
