Elements of liability
Tort liability ordinarily requires fault, actual harm and a causal connection between them. There is no compensation without proven harm, while fault may be presumed in specific cases such as responsibility for objects under a person's control.
Types of harm
Material harm includes both actual loss and lost profit. Moral harm may include injury to reputation, honour or dignity, as well as emotional suffering. Jordanian courts may award compensation for both categories.
Assessing compensation
The court considers the seriousness and circumstances of the harm and may rely on medical or technical experts. Early preservation of documents and evidence is therefore critical to a successful claim.
