Presumption of innocence

Every accused person is presumed innocent until convicted by a final judgment. This constitutional principle governs investigation and trial, and requires genuine doubt to be resolved in favour of the accused.

Investigation safeguards

The accused has the right to know the allegation, consult and be accompanied by a lawyer, decline to answer, and remain free from physical or psychological coercion.

A confession obtained through coercion is invalid and cannot properly support a conviction.

Detention and bail

Pre-trial detention is an exceptional measure subject to statutory time limits. Release may be requested with a personal or financial guarantee, and detention decisions may be challenged before the competent authority.
