When is dismissal unfair, and how are notice pay, accrued leave and end-of-service rights calculated?
Ways employment may end
Employment may end when a fixed term expires, through lawful termination on notice, or through justified dismissal in the limited cases specified by labour legislation.
Unfair dismissal
Where an open-ended contract is terminated without a lawful reason, the employee may claim unfair-dismissal compensation in addition to notice pay. The amount depends on the statutory framework and the circumstances of termination.
Employee entitlements
Claims may include unpaid wages, unused annual leave, overtime and end-of-service benefits where the employee is not covered by social security.
Employment claims are subject to limitation periods, so delaying legal action can affect recoverability.
